By inviting, installing, accessing, or using the Bot in any Discord server or environment, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Bot. This Terms of Service is based in part on the existing Zero Trust Security Terms of Service and adapted specifically for the ZTS Guard Discord Bot. *** ## 1. Description of Service ZTS Guard Bot is a Discord security and moderation tool designed to assist server owners, administrators, moderators, and communities with security monitoring, moderation workflows, anti-scam protections, logging, automation, alerts, and related security-focused functionality. The Bot is provided on an “as-is” and “as-available” basis. We reserve the right to modify, suspend, limit, or discontinue any feature or functionality of the Bot at any time without notice. *** ## 2. Eligibility & Authority By using the Bot, you represent and warrant that: * You are legally permitted to use Discord and third-party software integrations. * You have authority to add the Bot to any Discord server where it is installed. * You will comply with all applicable laws, regulations, and Discord Terms of Service. *** ## 3. Assumption of Risk **YOU UNDERSTAND AND AGREE THAT USE OF THE BOT IS ENTIRELY AT YOUR OWN RISK.** While ZTS Guard Bot is designed to improve server security and reduce malicious activity, no software, moderation system, automation, detection method, or security implementation can guarantee complete protection against scams, malware, phishing, social engineering, account compromise, server compromise, or any other malicious activity. By using the Bot, you acknowledge and agree that: * Security incidents may still occur despite use of the Bot. * The Bot may fail to detect, prevent, flag, or stop malicious behavior. * False positives, false negatives, outages, delays, configuration issues, API limitations, or unexpected behavior may occur. * Discord platform changes, third-party integrations, user actions, or external services may impact functionality or effectiveness. You assume full responsibility for your server configuration, moderation decisions, user management, permissions, security posture, and operational practices. *** ## 4. No Security Guarantee ZTS Guard Bot does NOT guarantee: * Prevention of hacks, scams, phishing, malware, wallet drains, impersonation, or social engineering. * Detection of all malicious links or threats. * Continuous uptime or uninterrupted service. * Compatibility with all Discord bots, APIs, integrations, or server configurations. * Preservation of server data, logs, messages, or configurations. The Bot is intended as a supplemental security tool and not as a replacement for proper operational security practices, moderation, or independent security review. *** ## 5. Limitation of Liability **TO THE MAXIMUM EXTENT PERMITTED BY LAW:** ZERO TRUST SECURITY LLC, ZERO TRUST SECURITY, ZTS GUARD BOT, ITS OWNERS, OPERATORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO: * USE OF OR INABILITY TO USE THE BOT; * SERVER COMPROMISES; * ACCOUNT COMPROMISES; * MALWARE, PHISHING, OR SOCIAL ENGINEERING INCIDENTS; * LOSS OF DIGITAL ASSETS, TOKENS, NFTs, OR CRYPTOCURRENCY; * LOSS OF PROFITS, REVENUE, DATA, BUSINESS, REPUTATION, OR GOODWILL; * USER ACTIONS OR THIRD-PARTY ACTIONS; * MODERATION ACTIONS TAKEN BY THE BOT; * FALSE POSITIVES OR FALSE NEGATIVES; * SERVICE INTERRUPTIONS OR TECHNICAL FAILURES; * DISCORD API CHANGES OR PLATFORM ISSUES. THIS LIMITATION APPLIES EVEN IF ZTS WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE BOT IS TO STOP USING IT. *** ## 6. Indemnification You agree to indemnify, defend, and hold harmless: * Zero Trust Security LLC * Zero Trust Security * ZTS Guard Bot * Its owners, affiliates, employees, contractors, agents, and partners from and against any claims, liabilities, damages, losses, expenses, legal fees, or demands arising from: * Your use of the Bot; * Your Discord server operations; * Violations of these Terms; * Violations of applicable laws or regulations; * User-generated content; * Moderation actions; * Security incidents involving your server or users. *** ## 7. User Responsibilities You are solely responsible for: * Proper configuration of the Bot; * Managing permissions and role hierarchy; * Reviewing moderation actions; * Maintaining operational security (“OPSEC”); * Securing administrator accounts; * Protecting credentials, wallets, and sensitive systems; * Monitoring your community and moderation environment. You agree not to: * Abuse, exploit, reverse engineer, or interfere with the Bot; * Use the Bot for unlawful purposes; * Attempt unauthorized access to systems or infrastructure; * Use the Bot in a manner that violates Discord’s Terms of Service or Community Guidelines. *** ## 8. Third-Party Services The Bot may interact with: * Discord APIs; * Third-party APIs; * External links; * Third-party moderation or security systems. ZTS is not responsible for the availability, actions, security, or practices of third-party services or platforms. Your use of Discord and any third-party service is governed by their respective terms and policies. *** ## 9. Intellectual Property All software, branding, logos, designs, systems, configurations, code, content, and intellectual property related to ZTS Guard Bot remain the exclusive property of Zero Trust Security LLC unless otherwise stated. You may not: * Copy, * Reproduce, * Resell, * Redistribute, * Reverse engineer, * Modify, * License, * Commercialize, any part of the Bot without prior written authorization. *** ## 10. Termination We reserve the right to suspend, restrict, or terminate access to the Bot at any time, with or without notice, for any reason, including but not limited to: * Violations of these Terms; * Abuse of the Bot; * Harmful or malicious activity; * Operational or legal concerns. *** ## 11. No Warranty THE BOT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ZERO TRUST SECURITY LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: * MERCHANTABILITY, * FITNESS FOR A PARTICULAR PURPOSE, * NON-INFRINGEMENT, * SECURITY, * RELIABILITY, * ACCURACY, * AVAILABILITY. We do not warrant that the Bot will be secure, error-free, uninterrupted, or free from harmful components. *** ## 12. Governing Law These Terms shall be governed and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the appropriate courts located within Texas. *** ## 13. Changes to These Terms We reserve the right to modify or update these Terms at any time without prior notice. Continued use of the Bot after changes become effective constitutes acceptance of the updated Terms. *** ## 14. Privacy Our Privacy Policy describes the information we collect from you, to whom we share that information with and for what purpose, and what we do with that information.
